The National Court has sentenced a student from Palma to return a grant of more than 2,000 euros for not going to class. Specifically, the ruling requires the student to reimburse the state for 2085 euros it received, plus interest. In total, you must pay 2310 euros.
This student has requested and obtained a grant from the Ministry of Education and Science for artistic photography first study in the School of Design in Palma during the year 2005/2006. Now it is returning the money he received and has failed one of the requirements: attend more than 50 percent of school hours.
Absenteeism
The secretariat of the school leaving certificate issued a record of student absenteeism, as their guardian reported that the student had missed more than half of the classes. Therefore, the general director of Territorial Cooperation, as dictated by the Ministry of Education in 2008, forced him to repay the grant received for 2292 euros, excluding the 207 euros was granted to buy books and school supplies.
The student appealed and argued that the Administration could not prove he had missed so much class and even said "that was presented to the English test in February 2006." In the words of the sentence of the Audiencia Nacional dismissing the appeal, no matter whether or not the student went to that test because it does not mean that students go to class. For all this and having been established that the aspiring photographer missed more than half of the classes, you must return the money received.
The call of the Ministry of Education and Science grants and General study for the academic year 2005/2006 was aimed at students of post-compulsory level non-university and university study in their autonomous community.
Requirements for scholarship
The invitation states that the secretariats of schools should check that students have benefited from a scholarship earmarked for the purpose for which it was granted, that is, when you unsubscribe fellow at the center before end of the course, when there is seen a fifty percent or more of the fixed-school hours unless it is exempt from enrollment, or for non-payment for services rendered by the center for which funding has been granted financial aid.
